You can reach a person at smartlabs.support@avabenet.com. Throughout this page, "we" and "us" mean Smart LABS, and "you" means the person buying.
By buying or using the product, you agree to these terms. If you don't agree with them, don't buy it — and if you already have, ask for a refund.
What you're buying
A digital product, delivered as files. Your purchase includes:
- The Switch-Off Protocol — a 40-page book, as a PDF
- Three guided audio tracks, as MP3 files
- The Bedside Card, as a printable PDF
- The Evening Wind-Down Checklist, only if you added it at checkout
There is no physical product, and nothing is shipped. There is no subscription and no recurring charge — you pay once.
How you may use it
We grant you a personal, non-exclusive, non-transferable licence to use the files for yourself, for as long as you like. Within that, you may read them on any device you own, print a copy for your own use, and come back to them whenever you want.
What you may not do: resell, sublicense, rent or share the files; upload them to a file-sharing service, forum or group; reproduce substantial parts of the text publicly; or present the material as your own work. Sharing a copy with your partner or someone in your household is fine — publishing it is not.
This is not medical advice
The Switch-Off Protocol is educational content about sleep behaviour. It is not medical advice, diagnosis or treatment, and it does not create any clinical relationship between you and us. We are not doctors, and this product does not claim to treat, cure or prevent insomnia or any other condition.
Sleep problems sometimes have medical causes — among them sleep apnoea, restless legs, thyroid conditions, depression and anxiety disorders, and side effects of medication. A book cannot detect any of those.
Please speak to a doctor or qualified health professional if your sleep problems persist beyond a few weeks, if you fall asleep involuntarily during the day, if you snore heavily or have been told you stop breathing in your sleep, if you're pregnant, if you're taking sleep medication or thinking of stopping any prescribed medication, or if you're experiencing low mood or distress. Nothing in this product should delay you getting help. If you are in crisis, contact your local emergency services.
What we don't promise
We believe in the protocol and we've made the guarantee generous because of that. But sleep is individual: what changes one person's nights within a week may do very little for another. We don't promise a specific result, a number of hours, or a timeframe.
Anything on our pages describing what the protocol does is a description of the method, not a guarantee of outcome for you.
Price, payment and tax
Prices are shown in US dollars. Payment is processed by Stripe — we never see or store your full card details. Your card issuer may apply a currency conversion or foreign transaction fee, which is between you and them.
Any sales tax or VAT that applies to your country is calculated and shown at checkout before you pay.
Delivery and access
Delivery is by email, to the address you enter at checkout, normally within minutes of payment. Download links may expire after a period for security reasons — if yours has expired or never arrived, email us and we'll send it again.
Please check your spam folder before assuming something went wrong, and make sure the email address you give us is one you can actually receive mail at. We can't deliver to an address that doesn't work.
You are responsible for keeping your own copy of the files once you've downloaded them.
Refunds and your cancellation rights
Our Refund Policy gives you 30 days, no questions asked, and forms part of these terms.
If you are a consumer in the UK or the EU, you normally have a statutory 14-day right to cancel. Because this is digital content delivered immediately, you are asked at checkout to consent to immediate access and to acknowledge that this ends that automatic right. Our 30-day guarantee applies regardless, so you are never worse off for having consented.
Intellectual property
The text, audio, design, artwork and typography of The Switch-Off Protocol belong to Smart LABS and are protected by copyright. Buying the product gives you the licence described above — it does not transfer ownership of anything.
Changes to the product and to these terms
We may improve the product, and we may update these terms — to reflect a change in what we offer, or a change in the law. When we do, we'll change the date at the top of this page. Material changes won't be applied retroactively to a purchase you've already made: the terms that govern your purchase are the ones published on the day you bought.
Limitation of liability
We provide the product with reasonable care, but as a digital product it is provided "as is". To the fullest extent the law allows, we are not liable for indirect or consequential loss, or for loss of profit, data or opportunity arising from your use of it.
Where liability cannot be excluded, it is limited to the amount you paid for the product.
Nothing here limits our liability for fraud, for death or personal injury caused by negligence, or for anything else that cannot lawfully be limited — and nothing here removes the statutory rights you have as a consumer in your own country.
If you misuse the product
We may end your licence if you redistribute or resell the files, or attempt to charge back a payment fraudulently. We would contact you first — this is a last resort, not an opening move.
Governing law
These terms are governed by the laws of Brazil, and the courts of Goiânia, Goiás have jurisdiction.
That said, if you are a consumer, this does not deprive you of the protection of the mandatory consumer law of the country where you live, or of the right to bring a claim before your local courts where your law gives you that right.
